General Counsel opines that broadly written <b>non-competition agreements violate Section 7 of the NLRA (29 USC Section 157) and that the proffer, maintenance and enforcement of such agreements constitute an unfair labor practice</b> in violation of Section 8(a)(1) of the NLRA, except in limited circumstances.</p><p>Section 7 protects an employee's right to engage in concerted activity for the purposes of collective bargaining or for other mutual aid or protection. The "other mutual aid or protection" clause of Section 7 applies to non-unionized workers as well as those belonging to a union. So <b>the guidance has wide-reaching implications for employers throughout the nation</b>. The memo lays out five ways in which non-competition agreements chill employees from engaging in concerted activity protected under Section 7: 1) they chill employees from concertedly threatening to resign to demand better working conditions, 2) they chill employees from carrying out threats to resign in order to secure improved working conditions, 3) they chill employees from concertedly seeking out and accepting employment from a local competitor (General Counsel pointed out that this would also include a lone employee's acceptance of work from a competitor as a logical outgrowth of concerted activity), 4) they chill employees from soliciting co-workers for employment by a competitor and 5) finally, they limit employees from the mobility necessary to engage in particular forms of protected activity such as union organizing.</p><p>In order to comply with Sections 7 and 8 of the NLRA, <b>non-competition agreements must be narrowly tailored to special circumstances justifying infringement of the employee's rights.</b> General Counsel specifically warned that the desire to avoid competition from a former employee is not sufficient for a special circumstances defense. General Counsel also opined that employee retention and protection of special training investments (i. e. training repayment agreement provisions or TRAPs) are unlikely to justify broad non-competition agreements. This foundation did not cause him to shy away from the pains of slavery in the nation. At only twelve years old, Morris started his legal career as an apprentice for an abolitionist lawyer. At twenty one years old, Morris was admitted to the Massachusetts Bar. Morris was the second Black person to become a lawyer in the United States. His legal career included filing the first major school desegregation case, Roberts v. City of Boston. This is the earliest reported case in the effort to ensure access to equal educational opportunity for Black people.</p><p><br /></p><p>About the collection: </p><p> Besides that of Frederick Douglass’ library, this exhibit is the only known surviving 19th century African American Library. If you peek into this collection, you will discover Morris' inspiration and resources he relied on to perform his zealous representation of formerly enslaved people and Irish immigrants. involve allegations of self-dealing, charging excessive fees or imprudent

Machina, I’ve assembled the universe of 401(k) plan fiduciary litigation and
have been able to identify and track defendants, commonalities in defendant
profiles, and other trends and factors in 401(k) plan governance.<o:p></o:p></span></p>

conducting a systematic and comprehensive study of 401(k) fiduciary breach

to the other databases, I would likely have done a more limited study of sample

On March 1, 2023, students, faculty, librarians and administrative staff members got together to discuss B.L. Blanchard's <i>The Peacekeeper</i> over pizza, salad and desserts. The Book Club members enjoyed themselves so much that we immediately chose a new book to read and discuss at the next meeting scheduled for Wednesday, April 12, 2023 from 12:00 to 1:00 pm in the Law Library Conference Room, Room 279. The book we'll be discussing is Zakiya Dalila Harris's <a href="https://www.amazon.com/Other-Black-Girl-Novel/dp/1982160144/ref=sr_1_1?crid=HLY6Y4IAYL2J&keywords=the+other+black+girl&qid=1678994829&sprefix=the+other+black+girl%2Caps%2C72&sr=8-1">The Other Black Girl</a>, a riveting novel about a young African American book editor at an otherwise all-white NYC publishing house. She is overjoyed when another African American female is hired. But then the new coworker becomes popular and overshadows the other. Then the threatening anonymous notes start arriving. do this summer for legal work?<o:p></o:p></span></p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;"><span style="font-size: 14.0pt; line-height: 107%;">Bebe:<span style="mso-tab-count: 1;"> </span>I
was the Inaugural Brown Rudnick Civil Rights Fellow at Lawyers for Civil Rights
(LCR). I worked on Haitian immigration matters, pro bono advice to small community
businesses, such as commercial lease disputes, and more.<o:p></o:p></span></b></p>
<p class="MsoNormal"><span style="font-size: 14.0pt; line-height: 107%;">How did you
like it?<o:p></o:p></span></p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;"><span style="font-size: 14.0pt; line-height: 107%;">Bebe: It was a wonderful experience
overall, but I especially loved working with the Haitian immigrant
community.<span style="mso-spacerun: yes;"> </span>As a daughter of Haitian
immigrants who speaks fluent Creole, I felt that I had found a niche where I
was able to bring my whole self to my work. <o:p></o:p></span></b></p>
<p class="MsoNormal"><span style="font-size: 14.0pt; line-height: 107%;">Now that you
have experience working at a law firm, do you have any advice for new law
students?<o:p></o:p></span></p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;"><span style="font-size: 14.0pt; line-height: 107%;">Bebe: As the firm’s fellow at Lawyers
for Civil Rights, my first advice to new students would be the reassurance that
with experience comes comfort.<span style="mso-spacerun: yes;"> </span>So,
embrace the discomfort and jump right in! Also, secondary sources are your best
friends and so are the research librarians!<o:p></o:p></span></b></p>
<p class="MsoNormal"><span style="font-size: 14.0pt; line-height: 107%;">Was there a
research tool that you found very useful this summer?<span style="mso-spacerun: yes;"> </span><o:p></o:p></span></p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;"><span style="font-size: 14.0pt; line-height: 107%;">Bebe: Yes! Practical Guidance on
LexisNexis and Practical Law on Westlaw were especially helpful with getting
myself familiar with specific legal issues and everything I need to know about
them.<o:p></o:p></span></b></p>

anything else that you know now that you wish you’d known earlier?<o:p></o:p></span></p>

Most legal research is online, but you cannot add emojis to search your search string in Lexis or Westlaw. Not even in Google. Because it is an image - cannot use an emoji as a search term.
